
Entry Condition Report - form 1b (moveable dwellings)
An Entry Condition Report describes the standard of repair for the premises and items included with the premises, such as furniture.The completion of an Entry Condition Report is in the interests of both parties. It enables the owner/manager to support legitimate claims in respect of damage to premises beyond fair wear and tear. It also protects tenants from claims that are not substantiated.
The Act provides that the report is evidence of the condition of the premises and inclusions.
A Tribunal may use the report as evidence if there is a dispute about the bond or condition of the premises at the end of the tenancy.
The report is to be completed by owner/manager and tenants at the start of the tenancy. Extra pages may be attached to the report if required and should be signed by all parties to the tenancy.
The owner/manager must give the tenant a copy of the report on or before the occupation date.
The tenant must return a copy of the report to the owner/manager within three days after the occupation date. After the tenant has returned the copy of the report, the owner/manager must provide the them with a copy of the form, signed by both parties.
The RTA does not require a copy of the report unless a dispute arises either during or at the end of the tenancy.
