Legislation for owners/managers in a moveable dwelling park

The RTA administers the Residential Tenancies and Rooming Accommodation Act 2008 (PDF 1.6MB). This Act applies to rented houses, moveable dwellings, units, flats, aged rental, houseboats and rooming accommodation. All types of rental housing are covered by this Act, including private rental, public housing, government, employer-run and community managed rental accommodation.

The Office of Fair Trading administers the Manufactured Homes (Residential Parks) Act 2003.

Caravan park operators/managers and private owners of rented caravans/manufactured homes need to be familiar with both Acts and their Regulations when dealing with issues relating to moveable dwelling premises.

Times when each Act applies

The Residential Tenancies and Rooming Accommodation Act applies to people who rent a caravan or a site, whether they own the caravan or not. The Act also applies when people live in rented manufactured homes.

The Manufactured Homes (Residential Parks) Act only applies when people live in, and own their manufactured home. The Residential Tenancies and Rooming Accommodation Act does not apply to these people.
