Notice of non-compliance

Update

Rental law changes introducing minimum housing standards came into effect for new tenancies (including renewed tenancy agreements) from 1 September 2023, and will come into effect for all remaining tenancies on 1 September 2024.

The RTA applies Queensland regulator model practices and principles to its compliance and enforcement activities, ensuring procedural fairness and equitable decision-making is undertaken in its work to deliver responsible use of public resources and effective regulation. 

Where isolated instances occur and where there is no history of non-compliance with the Act or other mitigating circumstances, the RTA may issue a Notice of non-compliance.

The notice reminds the party of their legislative requirements under the Act and states that the outcome for any future breaches of the same section of the Act may result in further enforcement actions such as a Penalty Infringement Notice (fine) or, for serious matters, prosecution.

Proactive investigations and compliance monitoring activities may also be undertaken by the RTA following the issuing of a Notice of non-compliance.
